What is an Annulment?
An Annulment is a legal procedure that dissolves the marriage (as if it never existed).
How do I annul my marriage?
You have to make an application with the Family Justice Courts. Thereafter, the set of nullity papers will be delivered to your spouse. Your spouse is at liberty to challenge or accept your application.
If your spouse challenges the application, the matter will become contested. Parties will have to attend Court to give their evidence. The Judge, after hearing the evidence, will determine whether the marriage should be nullified.
If your spouse accepts the application, the matter will become uncontested. You can set down your matter and a hearing date will be fixed for the Judge to review the papers. Parties will not have to attend Court (due to COVID-19). If the Judge is satisfied with the papers, an Interim Judgment will be granted.
How long does it take to annul my marriage?
It generally takes 4 to 6 months to annul your marriage (if the matter is uncontested). This includes a mandatory 3-month waiting period before the Certificate of Final Judgment can be applied for.
What are the reasons to have my marriage annulled?
You will have to prove at least one of the following reasons:
Non-consummation of marriage due to the incapacity of either party to consummate it
Non-consummation of marriage due to the wilful refusal of your spouse to consummate it
Either party did not validly consent to the marriage
Either party (although capable of giving a valid consent) was suffering from mental disorder as to be unfit for marriage
Your spouse was suffering from venereal disease at the time of marriage
Your spouse was pregnant by another person at the time of marriage
